Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you and Aratrikkaz Pty Ltd ("Aratrikkaz", "we", "us"). By using aratrikkaz.com or purchasing from us, you accept these Terms. They are governed by the Laws of New South Wales, Australia.

Who we are

Aratrikkaz Pty Ltd (ABN [ABN — pending ASIC registration], ACN [ACN — pending ASIC registration]) is a private Australian company. Our registered office is at [Registered office to be confirmed], Sydney NSW 2000, Australia. We design and sell luxury Indian and Indo-western wear through aratrikkaz.com and ship worldwide.

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase. By purchasing, you confirm that the payment method and personal details provided are yours and accurate.

Orders & pricing

All AUD prices on this site are inclusive of GST (10%) as required by the GST Act 1999 (Cth). International prices are converted at checkout. Prices shown to non-AU audiences may exclude tax depending on jurisdiction — final tax is shown at checkout.

Prices may change without notice; the price at checkout is the price you pay. We reserve the right to cancel orders in cases of obvious pricing error, fraud detection, payment issues, or stock unavailability — in which case we will issue a full refund.

Payment

We accept the payment methods displayed at checkout, processed by Stripe. We do not store or process card details ourselves. By placing an order you authorise us (via Stripe) to charge the agreed amount.

Custom-stitched pieces

Custom-stitched pieces are made to the measurements you provide. We will request confirmation by WhatsApp or email before stitching begins. Once stitching begins, custom pieces are not refundable except for manufacturing fault — under which we will remake or repair the piece at no cost. This does not limit your consumer guarantees under the Australian Consumer Law.

Shipping

See our Shipping Policy for lead times, carriers, duty-paid jurisdictions, and international transit timing. Risk of loss passes to you when the carrier confirms delivery. We are responsible for replacing items lost or damaged in transit prior to delivery confirmation.

Returns, exchanges, refunds

See Returns & Exchanges for the conditions and process, and Refund Policy for refund timing. Nothing in our return or refund policies limits your rights under the Australian Consumer Law.

Acceptable use

Your use of this site is governed by our Acceptable Use Policy. Breach may result in suspension of your account or refusal of future orders.

Intellectual property

All content on this site is the intellectual property of Aratrikkaz Pty Ltd or its licensors. See our Copyright Notice for details of permitted and prohibited uses.

Australian Consumer Law guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts, or modifies any non-excludable consumer guarantee, right, or remedy under the ACL.

Limitation of liability

To the extent permitted by law (including the ACL), our liability to you for any loss or damage arising from your use of this site or the goods you purchase from us is limited, at our option, to one of the following: (a) replacement of the goods or the supply of equivalent goods; (b) repair of the goods; (c) payment of the cost of replacing the goods or of acquiring equivalent goods; or (d) payment of the cost of having the goods repaired.

Indemnity

You agree to indemnify us against any claim arising from your breach of these Terms, your breach of any law, or your use of the site for any unlawful purpose, to the extent permitted by law.

Variation

We may update these Terms from time to time. Material changes will be notified via email to logged-in users and via a banner on the site. Continued use of the site after the change constitutes acceptance. The version date is shown at the top of this page.

Disputes

If you have a complaint, contact us first at legal@aratrikkaz.com. We will respond within 7 business days and work in good faith to resolve the issue.

If unresolved, you may contact your state or territory consumer protection agency (e.g. NSW Fair Trading) or, for online disputes, the Australian Financial Complaints Authority where relevant.

Governing law & jurisdiction

These Terms are governed by the Laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction over any dispute arising from these Terms.
